
A 37-year-old man is in custody after he allegedly shot at a person in a Walmart parking lot in Newark Tuesday.
According to a statement of facts, police were called to the parking lot of the Walmart on North 21st Street at about 5 p.m.
Witnesses said they observed Kyle Daughtery, 37, exiting Walmart. The victim ran up to Daugherty, stopping about 8 feet from him and a verbal argument ensued.

Witnesses say they observed Daugherty pull a gun out of his waistband, point it at the victim and fire a shot. Officers located a shell casing in the area and security video substantiated the accounts of witnesses.
Daugherty was found a short time later and questioned. He stated the victim had a knife, but witness accounts and security video did not show a weapon, according to the statement of facts.
Daugherty was scheduled to be in court for a bond hearing Wednesday afternoon.
Court records show that Daugherty currently is on federal probation for prior convictions for felony drugs and OVI.
