Newark man charged in connection to Walmart shooting - The Newark Advocate

NEWARK - A Newark man has been charged in connection to a shooting at the Newark Walmart.

Kyle A. Daugherty, 37, of 1717 W. High St., Newark,was arrested Tuesday evening and charged with one count of felonious assault, a second-degree felony.

Around 5:07 p.m. Tuesday, Newark police responded to the Walmart on North 21st Street, believing there may be an active shooter inside the store.

According to court records, witnesses told police they saw Daugherty exit the Walmart and the victim run up toward him, stopping about eight feet away. Witnesses said a verbal argument started between the two.

"At that point, witnesses observed the defendant pull a gun out of his waistband, point it at the victim, and fire a shot," an arrest warrant said.

Officers noted they found a shell casing in the area. The document noted witnesses didn't observe the victim with any weapon.

Newark police reported Daugherty allegedly admitted to shooting at the victim, but claimed the victim had a knife in his hand.

Four 911 calls were made to the Licking County Justice Center regarding the incident. One woman reported hearing a gunshot in the parking lot and two men fighting, trying to run each other over.

Another woman reported as soon as she had exited the store, someone shot into the store. She said the man was doing donuts in the Walmart parking lot and had just left down Goosepond Road.

Newark police said they didn't believe anyone was injured in the shooting and no one else was involved in it.

On Tuesday evening, the Newark Walmart released a statement via Facebook, saying no one was injured after a domestic incident in their parking lot. They said the store was secured and would be reopening shortly.

Court documents noted Daugherty is currently on federal probation and has prior convictions for felony drugs and OVI.

According to federal court records, Daugherty pleaded guilty to conspiring to manufacture methamphetamine in the Nebraska District Court in 2009. He was sentenced to serve five years in prison followed by five years of supervised release.
