$500 Walmart payout to its customers: only one week left to claim it - La Grada EN

The deadline to claim your part of the Walmart settlement is approaching for those who purchased “weighted goods” or “bagged citrus” from the retailer between Oct. 19, 2018, and Jan. 19, 2024. The settlements, which was adjudicated at the tail end of 2023, came about when shoppers noticed a discrepancy in prices in “weighted goods” and “bagged citrus” purchased around the country.

If you were one of the purchasers of these products, you may be in luck, as you may be eligible to get some of the proposed $45 million settlement. And you don’t even need a receipt! But you need to act fast if you think you are one of the damaged customers, as the deadline to file your claim is fast approaching, June 5, 2024.

The premise of the lawsuit is simple. Customers alleged that Walmart’s point-of-sale machines would disregard the advertised prices of “weighted goods” when they were marked at a “rollback” price, and fraudulently raise it so that customers would have to pay more than the original advertised discount price. On top of that, consumers noted that Walmart advertised and promoted bagged produce to weigh more than the actual weight of the item and that clearance products sold by weight, especially those marked with a “reduced price” sticker, also had differences between the advertised price per pound and the end price customers paid.

If you are unsure of whether or not your purchases fit within these parameters, “weighted goods” are those items that wouldn’t have a consistent weight and are thus priced based on said weight, like packaged meat, poultry, pork and seafood. “Bagged citrus” would be those fruits such as oranges, lemons, limes and grapefruit that, although you can sometimes find loose, often come in mesh bags with the weight and the price printed on them.

As it is usual on these types of cases, Walmart has not admitted to any fault and has denied all allegations of impropriety but has decided to settle the case as the company does not believe taking the matter to trial would be productive for the company or for consumers.

So, let us say that you would like to submit a claim. Are you one the people that are eligible?

Well, for starters you will have needed to have bought “weighted goods” or “bagged citrus” (or both) from a Walmart between Oct. 19, 2018, and Jan. 19, 2024. Anything purchased bore of after is not covered by this settlement.

And while it would be good that you had kept your receipts (if you are a Walmart member you may be able to find them on your personal area of the website) you do not actually need them to submit your claim. While the process would have been easier and the pay better, if you did not keep receipts you can still claim a portion of the settlement:

  • Customers who bought 1 to 50 “weighted goods” or “bagged citrus” can claim $10.
  • Customers who bought 51 to 75 “weighted goods” or “bagged citrus” can claim $15.
  • Customers who bought 76 to 100 “weighted goods” or “bagged citrus” can claim $20.
  • Customers who bought 101-plus “weighted goods” or “bagged citrus” can claim $25.

However, if you can find your Walmart receipts, you will be able to claim 2% of the total cost of the “weighted goods” and/or “bagged citrus” purchased, up to a maximum of $500. This maximum could be reduced depending on the number of claims submitted and approved, as the total may exceed the amount of the settlement.

The final hearing to finish the settlement is scheduled for June 16, 2024, after which date any payments that have been considered legitimate will be issued to consumers. The process may take a little time or be delayed by appeals, so if you are one of the affected individuals, be patient.
